Article 1 - Definition
In Spring Airlines Co., Ltd. General Conditions of Carriage for International Passengers and Baggage (hereinafter referred to as Conditions), except where the context otherwise requires, the following expressions shall have the meanings respectively assigned to them:
1.1 "Convention" means whichever of the following instruments are applicable:
The Convention for the Unification of Certain Rules Relating to International Carriage by Air, signed at Warsaw, 12 October 1929 (hereinafter referred to as the Warsaw Convention);
The Warsaw Convention as amended at The Hague on 28 September 1955 (hereinafter referred to as the Hague Protocol);
The Convention for the Unification of Certain Rules for International Carriage by Air, done at Montreal on 28 May 1999 (hereinafter referred to as the Montreal Convention).
1.2 "International Carriage" means, unless otherwise stated in the Convention, transportation in which, according to the contract of carriage, either the place of departure or the destination or an Agreed Stopping Place, whether or not there is a break in the transportation, is not situated in the People's Republic of China.
1.3 "Carrier" includes the air carrier issuing the ticket and all air carriers that carry or undertake to carry the passenger and/or his baggage there under.
1.4 "Airline Designator Code" means the two-character code or three–character code which is common practice in aviation industry to identify particular air carriers.
1.5 "Carrier Regulations" means rules, other than these Conditions, published by Carrier and in effect on the date of Ticket purchase, governing carriage of passengers and/or baggage and shall include applicable tariffs in force.
1.6 "Authorized Agent" means sales agent who has been appointed by Spring Airlines to represent the Spring Airlines in the sale of air passenger transportation over the service of Spring Airlines.
1.7 "Passenger" means any person, except members of the crew, carried or to be carried in an aircraft pursuant to a Ticket.
1.8 "Ticket" means document of carriage either as a paper document entitled "Passenger Ticket and Baggage Check" being delivered by Spring Airlines or its Authorized Agent to Passenger, which shall includes the Conditions of Contract, notices and Coupons or an Electronic Ticket.
1.9 "Conjunction Ticket" means a Ticket issued to passenger with relation to another Ticket which together constitute a single contract of carriage.
1.10 "Coupon" means a paper Flight Coupon, each of which entitles the named passenger to travel on the particular flight identified on the coupon or an Electronic Ticket.
1.11 "Electronic Ticket" means document of carriage preserves information of Ticket in digital data form and which substitutes traditional paper ticket, and may appears in Itinerary/Receipt issued by Spring Airlines or its Authorized Agent to Passenger, as statement of information so preserved .
1.12 "Passenger Coupon" means that portion of Ticket which is marked “For Passenger” and shall be reserved by Passenger.
1.13 "Flight Coupon "means that portion of Ticket which bears the notation ”Good for Transport” and indicates the particular places between which the passenger is entitled to be carried.
1.14 "Normal Fare" means the highest fare established for a first, or business, or economy/tourist class service during the period of applicability.
1.15 "Special Fare" means a fare other than the Normal Fare which is of lower price and with more restrictions.
1.16 "Days" means calendar days, including all seven days of a week for Spring Airlines; provided that, for the purpose of notification, the day upon which notice is dispatched shall not be counted; and that for purposes of determining duration of validity the day upon which the ticket is issued, or the flight commenced, shall not be counted.
1.17 "Baggage" means such articles, effects and other personal property of Passenger as are necessary or appropriate for wear, use, comfort or convenience in connection with the trip. Unless otherwise specify, it includes both Checked Baggage and Unchecked Baggage of the Passenger.
1.18 "Baggage Check" means those portions of the Ticket which relate to the carriage of the Checked Baggage.
1.19 "Baggage Identification Tag" means a document issued by Carrier solely for identification of Checked Baggage.
1.20 "Checked Baggage" means baggage of which Carrier takes custody and for which Carrier has issued a Baggage Check.
1.21 "Unchecked Baggage" means any Baggage of the Passenger other than Checked Baggage.
1.22 "Check-in Deadline" means the time limit specified by Carrier by which Passenger shall complete check-in formalities and be delivered boarding pass.
1.23 "Damage" means: (1) In the case of Passenger bodily injury or death, damage sustained and caused by an accident occurring on board the aircraft or in the course of any of the operations of embarking or disembarking; (2) In the case of loss, damage to or destruction of Checked Baggage, damage sustained while the Checked Baggage is on board the aircraft or at any time that the Checked Baggage is in charged of by Carrier; (3) In the case of Unchecked Baggage of which the Passenger takes charge, damage caused by the fault of Carrier or its agents.
1.24 "Force Majeure" means an unusual and unforeseeable circumstance beyond control and the consequences of which could not be avoided regardless of any due care being exercised.
1.25 "Notice of Contract Terms Incorporated by Reference" means those statements contained in or delivered with Ticket or Itinerary/Receipt of Passenger, identified as such and which incorporate by reference, these Conditions of Carriage and notices.
1.26 "SDR" means a Special Drawing Right as defined by the International Monetary Fund.
1.27 "Stopover" means a deliberate interruption of journey by Passenger, at a point between the place of departure and the place of destination, which has been agreed to in advance by Carrier.
1.28 "Tariff" means the published fares, charges and/or related conditions of carriage of Carrier filed, where required, with the appropriate authorities.
1.29 "Spring Airlines" is the shorter form of Spring Airlines Co., Ltd., the English name of 春秋航空股份有限公司, and also may be quoted herein as we, our or us, the first low-cost airline company established according to China law and headquartered in Shanghai China. The two-character Airline Designator Code is 9C; the three-character code is CQH; IATA settling account is 089; websites used are www.ch.com, www.springairlines.com, wap.china-sss.com and www.ChinaSpringTour.com.

Article 2 - Applicability
2.1 General
Except as provided in Articles 2.2, 2.4 and 2.5, these Conditions of Carriage apply only on those flights, or flight segments, where Spring Airlines or its Airline Designator Code is indicated in the “Carrier” box of the Ticket for that flight or flight segments.
2.2 Charter Operations
If carriage is performed pursuant to a charter agreement, these Conditions of Carriage apply only to the extent they are incorporated by reference by the terms of the charter agreement and the charter ticket.
2.3 Code Shares
On some services Spring Airlines may have arrangements with other carriers which is known as "Code Shares". This means that even if Passenger have a reservation with Spring Airlines and hold a Ticket where its name or Airline Designator Code is indicated as the Carrier, another carrier may operate the aircraft. If such arrangements apply, Spring Airlines will advise Passenger of the carrier operating the aircraft before he purchases Ticket.
2.4 Overriding Law
These Conditions of Carriage apply to International Carriage provided by Spring Airlines unless they are inconsistent with Tariffs of Spring Airlines or applicable laws in which event such Tariffs or laws shall prevail.
If any provision of these Conditions of Carriage is invalid under any applicable law, the other provisions shall nevertheless remain valid.
2.5 Conditions Prevail over Regulations
Except as provided herein, in the event of any inconsistency between Conditions and any other regulations of Spring Airlines, Conditions shall prevail.

Article 3 — Tickets
3.1 General
3.1.1 Ticket constitutes prima facie evidence of the contract of carriage between Carrier and the Passenger named on the Ticket. Spring Airlines will provide carriage only to Passenger holding a valid Ticket issued by Spring Airlines or Authorized Agent. The Conditions of Contract contained in Ticket are summary of the provisions of these Conditions of Carriage.
3.1.2 Ticket should at least include the following:
3.1.2(a) Name of Carrier
3.1.2(b) Name of Passenger
3.1.2(c) Original issuer, date and place of issue
3.1.2(d) Places of departure and destination
3.1.2(e) Fare and payment method
3.1.2(f) Ticket code
3.1.2(g) Free Baggage allowance
3.1.2(h) If the places of departure and destination are within the territory of People's Republic of China, one or more agreed stopping places being within the territory of another state, at least one such stopping place shall be indicated.
3.1.2(i) If one of the places of departure,destination or the agreed stopping places is not in the territory of People's Republic of China, in accordance with the applicable provisions of the Convention, provisions those applicable to the international carriage should be stated on the Ticket.
3.1.3 The Carrier or its Authorized Agent shall issue for each Passenger a separate Ticket.
3.1.4 Ticket is not transferable. If a Ticket is presented by someone other than the person entitled to be carried there under or to a refund in connection therewith, Spring Airlines shall not be liable to the person so entitled if in good faith it provides carriage or makes a refund to the person presenting the Ticket.
3.1.5 A Ticket is invalid if it has been tempered with.
3.1.6 Tickets sold at discount may be partially or completely non-refundable or restricted in other ways. Passenger should take caution to choose the fare that best suits needs.
3.1.7 The Ticket is and remains at all times the property of the issuing Carrier.
3.1.8 Except in the case of an Electronic Ticket, Passenger shall not be entitled to carriage unless Passenger presents a valid Ticket containing the Flight Coupon for that flight and all other unused Flight Coupons and the Passenger Coupon. In addition, Passenger shall not be entitled to be carried if the Ticket presented is mutilated or if it has been altered, other than by us or our Authorized Agent. In case of an Electronic Ticket, Passenger shall not be entitled to carriage unless he produces positive identification of a valid Electronic Ticket in his name.
3.1.9(a) In case of loss or mutilation of a Ticket (or part of it) by Passenger or non-presentation of a Ticket containing the Passenger Coupon and all unused Flight Coupons, upon request of Passenger and after our validation, Spring Airlines will replace such Ticket (or part of it) by issuing a new Ticket, provided there is evidence, readily ascertainable at the time, that a Ticket valid for the flight(s) in question was duly issued and Passenger warrant to reimburse us for any costs and losses, up to the value of the original Ticket, which may be incurred by us or another Carrier for misuse of the Ticket. Spring Airlines shall not claim reimbursement from Passenger for any such losses which result from its own negligence.
Spring Airlines may charge a reasonable administration fee for this service, unless the loss or mutilation was due to the negligence of Spring Airlines, or its agent.
3.1.9(b) Where such evidence is not available or Passenger will not sign such warranty, the Carrier issuing the new Ticket may require Passenger to pay up to the full Ticket price for a replacement Ticket. While the original issuing Carrier is satisfied that the lost or mutilated Ticket has not been used within one year after the Ticket issuing date or the travel commencement date, the lost or mutilated Ticket may be refunded.
3.1.10 Ticket is valuable paper and Passenger should take appropriate measures to safeguard it and ensure that it is not lost or stolen.
3.2 Period of Validity
3.2.1 Except as otherwise provided in Ticket, these Conditions of Carriage, or in applicable Tariffs which may limit the validity of Ticket, in which case the limitation will also be shown on Ticket, a Ticket is valid as follows:
3.2.1(a) A Ticket issued at Normal Fare is valid for carriage for one year from the date of commencement of travel or if no portion of the Ticket is used, from the date of issue.
3.2.1(b) The calculation of the validity of Ticket begins from zero hour of the next date of commencement of travel or from the next date of issue and end in the day one year thereafter.
3.2.2 The validity period of the Ticket shall be extended if Passenger is prevented from traveling within the period of validity of the Ticket because Spring Airlines:
3.2.2(a) cancels the flight on which the Passenger holds a reservation; or
3.2.2(b) omits a scheduled stop, which is the Passenger's place of departure, place of destination or a stopover; or
3.2.2(c) fails to operate a flight reasonably according to schedule; or
3.2.2(d) causes the Passenger to miss a connection; or
3.2.2(e) substitutes a different class of service; or
3.2.2(f) is unable to provide previously confirmed space.
3.2.3 When Passenger holding Normal Fare Ticket is prevented from traveling within the period of validity of the Ticket because Spring Airlines is unable to provide space on the flight upon request of reservations, the validity shall be extended.
3.2.4 When Passenger after having commencement of journey is prevented from traveling within the period of validity of the Ticket by reason of illness, Spring Airlines will extend the period of validity of such Passenger's Ticket until the date when the Passenger becomes fit to travel according to a medical certificate, or until Spring Airlines first flight after such date from the point where the journey is resumed on which space is available in the class of service for which the fare has been paid. When the Flight Coupons remaining in Ticket involve one or more stopovers, the validity of such Ticket will be extended for not more than three months from the date shown on such certificate. In such circumstances, Spring Airlines will provide similar extension to one (1) of the members accompanying such Passenger.
3.2.5 In the event of death of Passenger en route, the Tickets of the persons accompanying the Passenger may be modified by waiving the minimum stay or extending the validity. In the event of a death in the immediate family of Passenger who has commenced travel, the validity of the Passenger's Tickets and those of his or her immediate family accompanying the Passenger may be likewise modified. Any such modification shall be made upon receipt of a proper death certificate and any such extension of validity shall not be for a period longer than forty-five (45) days from the date of the death.
3.3 Coupons Sequence and Use
3.3.1 The Ticket Passenger have purchased is valid only for the transportation shown on the Ticket, from the place of departure via any Agreed Stopover Points to the final place of destination. The fare Passenger paid is based upon the Tariff of Spring Airlines and is for the transportation as shown on the Ticket. The Tariff for fare forms an essential part of contract of Spring Airlines with Passenger. The Ticket will not be honored and will lose its validity if Coupons are not used in the sequence as required.
3.3.2 Should Passenger wish to change any aspect of transportation, Passenger must contact us in advance. The fare for the new transportation will be re-calculated and Passenger will be given the option of accepting change or not. In case of change due to Force Majeure, Passenger shall contact us as soon as practicable and Spring Airlines will use reasonable efforts to transport Passenger to the next Stopover or final destination, without recalculation of the fare.
3.3.3 Should Passenger change the transportation without our agreement, Spring Airlines will assess the correct price for the actual travel. Passenger will have to pay any fare difference, if any, plus reasonable service fee. Any unused Coupons of Passenger's Ticket will be invalidated.
3.3.4 While some types of changes will not result in a change of fare, others, such as changing the place of departure or reversing the direction Passenger travel, may result in an increase in price. Many fares are valid only on the dates and for the flights shown on the Ticket and may not be changed at all, or only upon payment of an additional fee.
3.3.5 Each Flight Coupon contained in Passenger's Ticket will be accepted for transportation in the class of service on the date and flight for which space has been reserved, as shown in the Flight Coupon. When a Ticket is originally issued without a reservation being specified, space may be later reserved subject to the Tariff of Spring Airlines and the availability of space on the flight requested.
3.4 Name and Address of Carrier
Name of Spring Airlines may be abbreviated to Airline Designator Code or in other forms in the Ticket. Spring Airlines’ address shall be deemed to be the airport of departure shown opposite the first abbreviation of Carrier's name in the “Carrier” box in the Ticket, or, in the case of an Electronic Ticket, as indicated for our first flight segment in the Itinerary/Receipt.

Article 4 – Fares, Taxes, Fees and Charges
4.1 Fares
4.1.1 Fares apply only for carriage from the airport at the place of departure to the airport at the place of destination. Fares do not include ground transport service between airports or between airports and town terminals.
4.1.2 Applicable fares are the published fares published by Spring Airlines or, if not so published, constructed in accordance with Spring Airlines regulations. The applicable fare is the fare for the flight or flights in effect on the date of commencement of the carriage covered by the first Flight Coupon of the Ticket. When the amount that has been collected is not the applicable fare, the difference shall be paid by the Passenger, or, as the case may be, refunded by Spring Airlines. In accordance with regulation of Spring Airlines, should the Passenger request to change the itinerary, flight number or dates of travel, it may impact the fare to be paid.
4.1.3 Unless otherwise provided, fares apply only to routings published in connection therewith. If there is more than one routing at the same fare, the Passenger may select the routing prior to issue of Ticket. If no routing is selected, Spring Airlines or its Authorized Agent may determine the routing within their discretion. 4.2 Taxes, Fees and Charges
4.2.1 Any tax or charge imposed by government or other authority, or by the operator of an airport, in respect of a Passenger or the use by a Passenger of any services or facilities will be in addition to the published fares and charges and shall be payable by the Passenger.
4.2.2 At the time Passenger purchase Ticket, he will be advised of taxes, fees and charges not included in the fare, most of which will normally be shown separately on the Ticket. The taxes, fees and charges imposed on air travel are constantly changing and can be imposed after the date of Ticket issuance. If there is an increase in the applicable tax, fee or charge shown on the Ticket, the Passenger will be obliged to pay it prior to departure. Similarly, if any such tax, fee or charge is abolished so that it no longer applies to the Passenger, or reduced to lesser amount, he may be entitled to claim a refund of the difference from Spring Airlines.
4.3 Currency
4.3.1 Fares, taxes, fees and charges are payable in the currency of the country in which the Ticket is issued.
4.3.2 Spring Airlines may, at its discretion, accept payment in another currency due to, for example, the non-convertibility of local currency .When payment is made in a currency other than the currency in which the fare is published, such payment will be made at the rate of exchange published by a bank on the day such payment is made.

Article 5 – Reservations and Ticketing
5.1 Reservation Requirements
5.1.1 Spring Airlines or its Authorized Agent will record Passenger's flight reservation. Upon request Spring Airlines will provide Passenger with written confirmation of Passenger's reservation.
5.1.2 Certain fares have conditions which limit or exclude Passenger's right to change or cancel Passenger's reservations. For the individual terms of fares, please refer to respective Tariff conditions of Spring Airlines.
5.2 Ticketing Time Limits
5.2.1 Reservations will not be valid until the fare has been paid in accordance with the procedures and time limits. If Passenger has not paid for the Ticket prior to the specified Ticketing time limit, as advised by us or our Authorized Agent, Spring Airlines may cancel Passenger's reservation.
5.2.2 For paper Tickets, reservations will not be valid until a Ticket has been issued with the reservations listed on the corresponding Flight Coupon by Spring Airlines or its Authorized Agent. For Electronic Tickets, reservations will not be valid until a successful payment has been confirmed by Spring Airlines or its Authorized Agent's reservation system.
5.2.3 Spring Airlines shall provide seats in the class of service for which the Ticket has been issued.
5.3 Personal Data
Passenger recognize that personal data has been given to Spring Airlines in connection with Passenger's travel for the purposes of: making a reservation, purchasing a Ticket, obtaining ancillary services, developing and providing services, facilitating immigration and entry procedures, and making available such data to government agencies. For these purposes, Passenger authorizes Spring Airlines to retain and use such data and to transmit it to its offices, Authorized Agents, government agencies, other Carriers or the providers of the above-mentioned services.
5.4 No Guarantee of Seat
Spring Airlines will endeavor to honor advance seating requests,however, Spring Airlines cannot guarantee any particular seat. Spring Airlines reserve the right to assign or reassign seats at any time, even after boarding of the aircraft, for this is necessary for operational, safety or security reasons.
5.5 Reconfirmation of Reservations
5.5.1 If Passenger without any notice fails to take the seat that has been reserved for him on a flight, Spring Airlines shall be entitled to cancel any onward or return reservations that made or procured for the Passenger. A service charge may be payable. If prior notice is given before such failure or quit, the onward or return reservation shall be kept.
5.5.2 Spring Air will take the initiative to inform Passenger, if Spring Airlines require reconfirmation of existing reservations for onward or return Spring Airlines flights. Passenger should check the reconfirmation requirements of any other Carriers involved in Passenger's journey. Where reconfirmation is required, Passenger must reconfirm with the Carrier whose Airlines Designator Code appears for the flight in question on the Ticket.

Article 6 - Schedules, Delays and Cancellation of Flights
6.1 Schedules
6.1.1 The flight timings and aircraft types shown in timetables may change between the date of publication and the date of travel. Spring Airlines does not guarantee them and also they shall not form part of Passenger's contract with Spring Airlines.
6.1.2 Before Spring Airlines accept Passenger's reservation for a flight, the Passenger will be notified of the scheduled flight timings in effect as of that time, and it will be shown on the Passenger's Ticket. It is possible Spring Airlines may need to change the scheduled flight time subsequent to the issuance of Ticket. If Passenger provides Spring Airlines with contact information, Spring Airlines will endeavor to notify him of any changes. If, after Passenger’ purchasing Ticket, Spring Airlines make a significant change to the schedule flight time, which is not accepted by the Passenger, and Spring Airlines is unable to reschedule the Passenger, he will be entitled to a refund in accordance with Article 8.2.
6.2 Cancellation and Delays
6.2.1 Spring Airlines will take all measures that could reasonably be required to avoid delay in carrying Passenger and his Baggage. Spring Airlines shall not be liable if it proves that Spring Airlines took all measures that could reasonably be required to avoid damage or that it was impossible for Spring Airlines to take such measures.
6.2.2 Except as otherwise provided by the Convention, if Spring Airlines cancels a flight, fails to operate a flight reasonably according to the schedule, fails to stop at the point of destination or stopover, or causes Passenger to miss a connecting flight on which the Passenger holds a confirmed reservation, Spring Airlines, with due consideration to the Passenger's reasonable requirement, shall either:
6.2.2.1 Carry the Passenger at the earliest opportunity on Spring Airlines’ another scheduled services on which space is available or, where necessary, extend the validity of the Passenger's Ticket, all without making any additional charges; or
6.2.2.2 Make a refund in accordance with the provisions of Article 8.2.
6.2.3 Upon the occurrence of any of the events set out in Article 6.2.2 , except as otherwise provided by the Convention, the options outlined in Article 6.2.2.1 through 6.2.2.2 are the sole and exclusive remedies available to the Passenger and Spring Airlines shall have no further liability to the Passenger.
6.2.4 When circumstances so require, Spring Airlines may, without prior notice, cancel, terminate, postpone, or delay any flight and adhere to the provisions of Article 7.2.2.
6.2.4.1 In order to comply with any applicable laws, regulations or orders of China and any other state or country to be flown from, into or over; or
6.2.4.2 In order to assure safe operation of a flight; or
6.2.4.3 For any circumstances beyond the control and prediction of Spring Airlines.

Article 7- Change
7.1 Passenger who has not commenced the trip, or commenced trip already but before getting to the destination requested to change destination, seat class, flight or Ticket validity period whichever were indicated on the unused leg, shall be deemed as voluntary change.
7.1.1 For voluntary change, it shall act as follows,
7.1.1.1 Any request for change shall be made prior to the destination as shown in the Ticket;
7.1.1.2 The Tariff for fare and other fees as applicable in the date that appeared in the departure date of the first Flight Coupon of original Ticket shall be applied to recalculate.
7.1.1.3 Any differences after taking into change shall be settled accordingly the balance paid to Carrier or the Passenger.
7.1.1.4 The term of validity for the new Ticket shall be same as the term of validity as the original one after the change. It shall be counted from zero hour the next day of the date of departure of the original Ticket.
7.1.1.5 Any restrictions upon the Ticket shall be met before change application can be honored.
7.1.2 Change of Passenger ID or Name
7.1.2.1 Any application for change of Ticket due to typo of Passenger name or ID shall be made within the time limit prior to scheduled departure.
7.1.2.2 Change of Passenger as appeared in Ticket shall be deemed as voluntary refund as per article 8.3.
7.1.2.3 Certificate type is not allowed to change together with the Passenger name, and family name shall not be changed.
7.1.2.4 Spring Airlines will charge the Passengers who apply for above changes, provided the typo is not due to mistake of Spring Airlines or its agent.
7.2 Involuntary Change
7.2.1 If Passenger's itinerary changes have to be made due to Spring Airlines cancellation of scheduled fight, of confirmed seats, of previously agreed destination or stopover point, and/or due to any other unreasonable change of flight schedule, it shall be deemed as involuntary change.
7.2.2 In case involuntary change is due to reasons listed in article 6.2.4, article 6.2.2. shall apply.

Article 8 – Refunds
8.1 Spring Airlines will refund Ticket or any unused portion thereof, in accordance with its own applicable fare rules or Tariff, including rules as follows:
8.1.1 Spring Airlines shall be entitled to make refund only to the person named Passenger in the Ticket.
8.1.2 If Ticket has been paid for by a person other than the Passenger named in the Ticket, and Spring Airlines has indicated on the Ticket that there is a restriction on refund, Spring Airlines shall make a refund only to the person paying for the Ticket or to that person's order. If a person other than the Passenger named in the Ticket requests refund, Spring Airlines shall be entitled to make a refund only to the person requesting refund, upon presentation of satisfactory proof of its own identification, the identification (original ID card or its true copy) and proxy of the Passenger.
8.1.3 Passenger requesting refund shall fill in “REFUND APPLICATION FORM” as prescribed by Spring Airlines. Except in the case of lost Tickets, refunds will only be made on surrender to Spring Airlines of the Passenger Coupon or Passenger receipt and surrender of all unused Flight Coupons.
8.1.4 Refund due to Illness
8.1.4.1 In case Passenger wishes to refund due to sickness, he shall show the Carrier his diagnostic certificate or medical record signed by doctor or certain medical organization above county level prior to scheduled departure. If Passenger falls into sickness all of a sudden or at stopover and he has no way to get such proof, the Ticket shall be signed by airline staff on duty at check-in counter or the head of cabin crew as Spring Airlines as well as the person in charge of that stopover before the refund would be made.
8.1.4.2 In case of refund due to illness, full paid fare will be refundable if it is made before flight departure, or the balance of full paid fare less any used leg shall be refunded if in stopovers.
8.1.4.3 In case the companion of the sick Passenger request refund, it may be granted at same time for free. For more than one companion, refund for the other shall be made in accordance with Article 8.3.
8.1.5 Refund on Death of Passenger
8.1.5.1 In case of death to a Passenger before or during his journey, his immediate family member or their proxy or the person paid for the Ticket may request refund, by presenting proper death certificate and the refund will be made free of charge.
8.1.5.2 In case of refund for death, full paid fare will be refundable if it is made before flight departure, or the balance of full paid fare less any used leg shall be refunded if in stopovers.
8.1.5.3 In case the companion of the dead Passenger request refund, it shall be made at the same time for free. For more than one companion, refund for the other shall be made in accordance with Article 8.3.
8.1.5.4 A Passenger requests refund by reasons of death of his immediate family not accompanying him, refund will be made in accordance with the regulations specified in Article 8.3.
8.1.6 Except in the case of lost Tickets, refunds will only be made on surrender to us of the Passenger Coupon, Passenger Receipt and surrender of all unused Flight Coupons.
8.2 Involuntary Refunds
8.2.1If Spring Airlines cancels the flight, delays for more than 5 hours, or fails to stop at the Passenger's destination or Stopover, or causes the Passenger to miss a connecting flight on which he holds a reservation, the amount of the refund shall be:
8.2.1.1 if no portion of the Ticket has been used, an amount equal to the fare paid;
8.2.1.2 if a portion of the Ticket has been used, the refund will be no less than the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used, provided that the refund shall not exceed the total fare paid.
8.3 Voluntary Refunds
8.3.1 If a Ticket is refundable and the Passenger asks for refund based on reasons other than those set out in Article 8.2, the amount to be refunded shall be:
8.3.1.1 If no portion of the Ticket has been used, an amount equal to the fare paid, less any reasonable service charges or cancellation fees;
8.3.1.2 if a portion of the Ticket has been used, the refund will be an amount equal to the difference between the fare paid and the applicable fare for travel between the points for which the Ticket has been used, less any reasonable service charges or cancellation fees.
8.3.2 For Special Fare Ticket, request to refund shall be handled in accordance with the applicable special conditions, if any.
8.4 Refunds on Lost Ticket
8.4.1 For refund on lost Ticket or portion of it, satisfactory proof of fact of the loss shall be presented to Spring Airlines, and subject to payment of a reasonable service fee, refund may be made after one year of the Ticket issuing date or the travel commencement date, on condition:
8.4.1.1 That the lost Ticket, or portion of it, has not been used, previously refunded or replaced, (except where the use, refund or replacement by or to a third party was resulted from our own negligence);
8.4.1.2 That the person to whom the refund is made undertakes, in such form as may be prescribed by Spring Airlines, to repay us the amount refunded in the event of fraud and/or to the extent that the lost Ticket or portion of it is used by a third party (except where any fraud or use by a third party is resulted from our own negligence).
8.4.2 If Spring Airlines or its Authorized Agent lose the Ticket or a portion of the Ticket, the loss shall be its own responsibility.
8.5 Right to Refuse Refund
8.5.1 Spring Airlines may refuse a refund where application is made after the expiry of the validity of the Ticket.
8.5.2 Spring Airlines may refuse a refund on a Ticket which has been presented to it, or to government officials, as evidence of intention to depart from a country, unless the Passenger establishes to Spring Airlines satisfaction that the Passenger has permission to remain in the country or that he will depart by another carrier or through another means of transport.
8.6 Currency
Spring Airlines reserves the right to make a refund in the same manner and in the same currency being paid for the Ticket.
8.7 Who to Refund
Voluntary refunds will be made only by Spring Airlines or by its agent if so authorized.
8.8 Refund to Credit Card or Debit Card Accounts
Refund for Ticket paid with credit card or debit card can only be credited to the card account originally used for the purchase. The refundable amount to be paid by Spring Airlines will be on the basis of the amount and the currency originally paid by the Passenger. The refundable amount to be credited may vary from the originally debited amount due to differences in currency conversion. Such variances do not entitle the recipient of the refund to a claim against Spring Airlines.

Article 9- Overbooking
9.1 Spring Airlines will not deploy oversell strategic. If for rare reasons which caused de facto overbooking and the aircraft cannot satisfy all those who have booked seats, Spring Airlines will firstly to seek volunteer, who are voluntary to quit his seat, and to provide compensate as follows:
9.1.1 If Passenger voluntarily takes refund or agree to be endorsed to other carrier. Spring Airlines will not charge any refund service fee and a compensation for each Passenger CNY 200 or of equal value will be provided.
9.1.2 If Passenger agrees to change into a later flight of Spring Airlines or be endorsed to other carrier's flight, Spring Airlines will bear all relevant expenses.
9.1.3 Spring Airlines will not provide cash compensation to those who hold free Ticket, our employee staff, or those specially approved guests holding discount Ticket, and except there are special agreements to say the contrary, the compensation standards and service to a group Ticket holder shall be the same as to other Passenger.
9.1.4 For connecting Passenger, the cash compensation will only be applicable for the overbooked leg. According to itinerary change, Spring Airlines will accommodate any necessary changes, refunds or boarding and lodging to such rearrangement free of charge to the Passenger.
9.1.5 Shall the re-scheduled flight be later for 4 hours or above and further delayed to 22:00 or later local time, Spring Airlines will accommodate the Passenger in standard hotel room with lavatory free of charge. Furthermore, Spring Airlines will provide Passenger with the ground transportation between the airport and hotel and our staff will assist Passenger to check-in.
9.2 In case of involuntary bumped-off, seat priorities shall go as follows:
9.2.1 VIP and his companions.
9.2.2 Special Passengers Spring Airlines agrees to guarantee in advance.
9.2.3 Passenger of a group.
9.2.4 Passenger in urgent connecting needs.
9.2.5 Passengers with other special needs or difficulties.
9.2.6 Frequent Flyer Program member of Spring Airlines.
9.2.7 Other normal Passengers.
9.3 Notices for overbooking are available throughout booking offices of Spring Airlines and in its web site or other proper information desks.

Article 10 Check-in and Boarding
10.1 Check-in Deadlines may be different at each airport and Spring Airlines recommend that Passenger should check out these Check-in Deadlines and comply with them. Spring Airlines reserves the rights to change the Check-in Deadlines accordingly. Spring Airlines or its Authorized Agents shall advise Passenger of the Check-in Deadline of the first flight of a successive carriage if we are the first Carrier. For any subsequent flights on Passenger's journey, he should inform himself of the Check-in Deadlines. Check-in Deadlines for specific flights can be obtained from Spring Airlines or its Authorized Agents.
10.2 Passenger shall arrive at Spring Airlines check-in location and boarding gate sufficiently in advance of flight departure to permit completion of any government formalities and departure procedures.
10.3 If Passenger fails to arrive in time at Spring Airlines check-in location or boarding gate or appears improperly documented and not ready to travel, Spring Airlines may cancel the space reserved and will not delay the flight.
10.4 Spring Airlines will not be liable to Passenger for any loss or expense incurred due to his failure to comply with the provisions of this Article 10.

Article-11 Refusal and Limitation on Carriage
11.1 Right to Refuse Carriage
Spring Airlines may refuse carriage of any Passenger or Passenger's Baggage for reasons of safety or if, in the exercise of its reasonable discretion, Spring Airlines determines that:
11.1.1 Such action is necessary to comply with any applicable laws, regulations or orders of any state or country to be flown from, into or over; or
11.1.2 The conduct, age or mental or physical state of the Passenger is unfit for air transportation and is such as to cause discomfort or make himself or herself objectionable to other Passenger or pose hazard or risk to himself or to other persons or to property; or
11.1.3 Such action is necessary because the Passenger has failed to observe the instructions of Spring Airlines; or
11.1.4 The Passenger has refused to submit to a security check; or
11.1.5 The applicable fare or any charges or taxed payable have not been paid; or
11.1.6 The Ticket presented by the Passenger has been acquired unlawfully or has been purchased from an entity other than the issuing Carrier or its Authorized Agent or has been reported as being lost or stolen or such Ticket is a counterfeit Ticket
11.1.7 Passenger have failed to comply with the requirements set forth in Article 3.3, or Passenger present a Ticket which has been issued or altered in any way, other than by Spring Airlines or its Authorized Agent, or the Ticket is mutilated;
11.1.8 The person presenting the Ticket cannot prove that he is the person named in the 'Name of Passenger' box.
11.1.9 The Passenger does not appear to be properly documented.
11.1.10 The Passenger may seek to enter a country through which he is in transit or the Passenger may destroy his documentation during flight or the Passenger will not surrender travel documents to be held by the flight crew in compliance with Spring Airlines requirement; or
11.1.11 The Passenger does not comply with the instructions of safety or security.
11.1.12 The Passenger does not comply with the regulation of no smoking or the use of electronic devices on board.
11.2 Special Service
11.2.1 Special Passengers including VIP, unaccompanied children, aged person, pregnant woman, infant, sight or hearing impaired passenger, criminal or suspects, confidential secretary, diplomatic courier, passenger need extra seat for himself or for his Baggage, secret passenger, stretcher person, disabled and sick, repatriated and other passenger who need special assistance is subject to prior approval and arrangement with Spring Airlines.
11.2.2 Carriage of Children
Children less than 5 years old shall travel with an adult companion Passenger who shall be at least 18 years old and without any physical or mental disability. For children aged between 5 and 12 years old, he may travel unaccompanied with prior approval of Spring Airlines, and Ticket fare and service fee shall be calculated accordingly. Regulation concerning the carriage of accompanied children can be obtained from Spring Airlines.
11.3 Refund after the Refusal on Carriage
11.3.1 Passenger being denied boarding or canceled seats for reasons stated in Article 11.1.1 may seek refund in accordance with Article 8.2.
11.3.2 Passenger being denied boarding or canceled seats for reasons stated in Article 11.1.2 to Article 11.1.12 may seek refund in accordance with Article 8.3.

Article 12 – Baggage
For domestic leg which constitutes a part of the international carriage, the Baggage transport shall also be performed under Conditions.
12.1 Free Baggage Allowance
In respect of international carriage performed by Spring Airlines, the free Baggage allowance will be determined on the basis of weight concept. Except as otherwise provided in our regulations, the free Baggage allowance for each Passenger, including Checked Baggage and Unchecked Baggage, will be limited as follows:
12.1.1 Free Allowance for Adults
A Passenger paying applicable economy class fare is entitled to a free Baggage allowance of 15 Kilograms, Including Checked Baggage and Unchecked Baggage.
12.1.2 Free Allowance for Children/Infants
Children are entitled to the same free Baggage allowance as adult Passengers. Infants are not entitled to a free Baggage allowance, and shall only be entitled to one fully collapsible stroller or pushchair. Infants paying the children's fare are entitled to the same free Baggage allowance as adult Passengers.
12.1.3 Where two or more Passengers, traveling as one party to a common destination or Stopover by the same flight, present themselves and their Baggage for travel at the same time and place or prove it in other ways, will be permitted to combine their Baggage allowance under either the weight or piece concept.
12.1.4 For the domestic leg of international carriage, the free Baggage allowance for Passenger will be determined by the regulation for the appropriate international leg.
12.1.5 Where voluntary rerouting is made, Passenger shall be entitled to the free Baggage allowance appropriate to the class of service for the rerouted portion. Where involuntary rerouting is made, Passenger shall be entitled to the free Baggage allowance applicable to the fare originally paid.
12.1.6 Any devices of necessity for handicapped (wheel chairs, sticks, prosthesis, etc.) shall be transported for free.
12.2 Excess Baggage Fee
12.2.1 Excess Baggage means the Baggage to be carried in excess of the free Baggage allowance, regardless for checked and Unchecked Baggage and special charge will be assessed for such Baggage.
12.2.2 Rate of the excess Baggage fee shall be 1.5% of the Normal Fare as published in local currency per kilogram.
12.2.3 Excess Baggage Ticket shall be provided to evidence such charge.
12.3 Items Unacceptable as Baggage
12.3.1 Passenger must not include in his Baggage, whether as Checked Baggage or Unchecked Baggage:
12.3.1.1 Items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the International Civil Aviation Organization (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air and the International Air Transport Association (IATA) Dangerous Goods Regulations, and in Spring Airlines regulations. The following items expressly are unacceptable as Baggage: explosives, compressed gases, corrosives, oxidizing, radioactive or magnetized materials, materials that are easily ignited, poisonous, offensive or irritating substances, and similar items as to which further information is available from Spring Airlines on request;
12.3.1.2 Items the carriage of which is prohibited by the applicable laws, regulations or orders of any state to be flown from, through or to;
12.3.1.3 Items which are reasonably considered by Spring Airlines to be unsuitable for carriage because they are dangerous, unsafe or by reason of their weight, size, shape or character, or which are fragile or perishable having regarded to, among other things, the type of aircraft being used. Information about unacceptable items is available upon request.
12.3.2 Firearms and ammunition, other than for hunting and sporting purposes, are prohibited from carriage as Baggage. Firearms and ammunition for hunting and sporting purposes may be accepted as Checked Baggage. Firearms must be unloaded with the safety catch on, and suitably packed as determined by Spring Airlines. Carriage of ammunition is subject to ICAO and IATA regulations as specified in 12.3.1.1, and also to the applicable laws, regulations or orders of any state to be flown from, through or to.
12.3.3 The Passenger must not include in his Checked Baggage money, jeweler, precious metals, computers, personal electronic devices, negotiable papers, securities or other valuables, prescribed medicine to be taken regularly, business documents, passports and other identification documents or samples.
12.3.4 Toy weapons such as antique firearms, swords, knives and similar items may be accepted as Checked Baggage, if properly packed in accordance with Spring Airlines regulations, but will not be permitted in the cabin.
12.3.5 If, despite being prohibited, any items referred to in 12.3.1, 12.3.2 or 12.3.3 are included in a Passenger's Baggage, Spring Airlines shall not be responsible for any loss, damage or confiscation of any such item by any authorities.
12.4 Right to Refuse Carriage
12.4.1 Spring Airlines may refuse carriage of such items as described in Article 12.3 above in the first place or refuse any further carriage upon immediate finding.
12.4.2 Spring Airlines may refuse to carry as Baggage any item considered to be unsuitable for carriage because of its size, shape, weight, content, character, or for safety or operational reasons, or for the comfort and convenience of other Passenger. Information about such unacceptable items is available upon request.
12.4.3 Spring Airlines may refuse to accept Baggage for carriage unless it is properly and securely packed in suitable containers. Information about packing and containers requirement is available upon request.
12.5 Right to Search
To safeguard safety and security, Spring Airlines may request permit a search and scan of Passenger's body and a search, scan or X-ray of his Baggage. If a Passenger is not available, his Baggage may be searched in his absence for the purpose of determining whether he is in possession of or whether his Baggage contains any item described in 12.3.1 or any firearms, ammunition or weapons, which have not been presented to Spring Airlines in accordance with 12.3.2. If Passenger is unwilling to comply with such request, Spring Airlines may refuse carriage. In the event such search or scan or X-ray causes damage, Spring Airlines shall not be liable for such damage unless it is solely due to our fault.
12.6 Checked Baggage
12.6.1 Packing for Checked Baggage should be in perfect condition, well locked and firmly tied up, and be capable to bear certain amount of pressure. Baggage shall be safely loaded or unloaded for normal operation conditions and meet with the following requirement:
12.6.1.1 Suitcase, traveling bag and hand bag must be locked.
12.6.1.2 Do not tie up two or more packages into one.
12.6.1.3 No foreign object shall be inserted on Baggage.
12.6.1.4 Bamboo basket, string bag, straw rope, paper bag shall not be used as outer wrapping.
12.6.1.5 If Baggage has no tag of name, initials, phone number or other personal identification, the Passenger shall affix such information to the Baggage prior to acceptance for carriage.
12.6.1.6 Saw dust, husk, grass ash, etc., shall not be used as stuffing material.
12.6.2 Weight limit of each piece Baggage shall be 50 Kilograms, and the size shall not exceed 40cmx60cmx100cm. Acceptance of any over-weighted or oversized Baggage shall be subject to prior permission of Spring Airlines.
12.6.3 Upon acceptance for carriage, a Baggage Identification Tag for each piece of Checked Baggage shall be issued by Spring Airlines to Passenger.
12.6.4 The name or other personal identification shall be marked on the inner and outside of the Checked Baggage.
12.6.5 Checked Baggage will, whenever possible, be carried by the same flight as Passenger takes, unless Spring Airlines otherwise decides for safety, security or operational reasons. If a Passenger's Checked Baggage is carried on a subsequent flight, Spring Airlines will deliver it to the Passenger, unless he is required by applicable laws or regulations to be present for customs clearance.
12.6.6 Excess Value Declaration
12.6.6.1 Passenger may declare a value for Checked Baggage in excess of USD20 (or its equivalent) per kilogram.
12.6.6.2 The declared value of any Checked Baggage shall not exceed its actual value. The maximum limit of declared value is USD2,500. Spring Airlines may refuse to accept as Baggage in cases it is over the maximum or the Passenger refuses Spring Airlines to verify its actual value.
12.6.6.3 Spring Airlines may refuse to accept an excess value declaration on any Checked Baggage in case a portion of the carriage of such Baggage is provided by another Carrier which does not offer the excess value declaration service.
12.6.6.4 When such a declaration is made the excess value charge shall be at the rate of 5‰ of such excess value as described in article 12.6.6.1. If the currency value is in RMB, the decimal part should be rounded up. If the Passenger declaration value is made in foreign currency, it shall be converted to RMB in accordance with buying rate at that day as published by local bank.
12.6.6.5 Any Baggage being made excess valuation declaration shall not be included in the free Baggage allowance of the Passenger.
12.6.6.6 No excess value facility will be offered for any pet animals.
12.7 Unchecked Baggage
12.7.1 Any carried-on Baggage shall not exceed 5 kilograms in weight and 20cm*30cm*40cm in size. A Passenger shall only carry on one Unchecked Baggage into the cabin. The carried-on Baggage shall fit under the seat in front of him or fit in the enclosed overhead storage compartment. Any Baggage which cannot be stored in this manner, or is of excessive weight, or is considered unsafe for any reason, shall be carried as Checked Baggage.
12.7.2 Objects not suitable for carriage in the cargo compartment of the aircraft, for example, delicate musical instruments, and which do not meet the requirements in 12.7.1, will only be accepted for carriage in the cabin of the aircraft and Passenger shall obtain prior consent from Spring Airlines. The Passenger may have to pay a separate charge for this service.
12.8 Collection and Delivery of Checked Baggage
12.8.1 Subject to Article 12.6.5, Passenger is required to collect his Checked Baggage as soon as it is made available at his destination or Stopover. Should the Passenger not collect it within a reasonable time, Spring Airlines may charge him a storage fee. Should his Checked Baggage not be claimed within three (3) months of the time it is made available, Spring Airlines may dispose of it without further notice or any liability to him.
12.8.2 Only the bearer of the Baggage Check and Baggage Identification Tag is entitled to accept delivery of the Checked Baggage.
12.8.3 If the person claiming Checked Baggage is unable to produce the Baggage Check and identify the Baggage by means of a Baggage Identification Tag, Spring Airlines will deliver the Baggage to such person only on condition that he establishes to its satisfaction his right to the Baggage.
12.9 Animals
12.9.1.1 Small animals refer to dogs, cats, household birds and other pets. Wild animals and other animals with strange shapes or are likely to injure people such as snakes are not included in the category of small animals, and can not be transported as Baggage. The following rules shall apply to the carriage of small animals:
12.9.1.2 Any pet animal shall be checked-in per regulation requirement before accepted by Spring Airlines for transportation.
12.9.1.3 Valid health and vaccination certificates, exit, entry or passage permits, and other documents required by China and any other countries related shall be presented for carriage. 12.9.1.4 Animals must be carried in an appropriate pet carrier. The carriers must be leak-proof, well ventilated and can also prevent animals from destroying, escaping and stretching outside the container so as not to contaminate the aircraft and other equipment.
12.9.1.5 If accepted as Baggage, the animal, together with its container and food, shall not be included in free Baggage allowance and the Passenger shall pay the applicable charge as excess Baggage. Animals shall not be carried in the Passenger cabin without prior permission.
12.9.2 Guide dogs are specially trained to give the assistance to sight or hearing impaired Passengers. Carriage for guide dogs accompanying sight or hearing impaired Passengers, certificate from doctor may be required, shall be as follows:
12.9.2.1 Guide dogs, together with containers and food, will be carried free of charge in addition to the standard free Baggage allowance, subject to Spring Airlines regulations.
12.9.2.2 All in-cabin animals must wear mask and be tied to the rope. It shall be restrained in movement and no seat shall be occupied by the animal. If to be carried in the cargo compartment, container for the animals shall be in accordance with the provisions of Article 12.9.1.4.
12.9.2.3 Other conditions shall include regulations specified in paragraph 12.9.1.1, 12.9.1.2, 12.9.1.3.
12.9.3 Spring Airlines will not be liable for injury to, loss of, sickness of or death of the animal except it is caused by fault of Spring Airlines.
12.9.4 Spring Airlines will not be liabe for any such animal with no necessary exit or entry permit, health certificate or other documents. Passenger carrying the animal shall reimburse Spring Airlines for any fines, costs, losses or liabilities may be imposed to or incurred by Spring Airlines as a result of such absence or insufficiency of required documents.
12.9.5 The Passenger is liable for all damages or injuries which the animal might cause to other Passengers or crew members.
12.9.6 Spring Airlines reserves the right to refuse to transport any animal including guide dogs in non-stop long-distance flights or with certain types of aircraft.
12.10 Withdrawal of Checked Baggage
12.10.1 In case of voluntary rerouting or cancellation of transportation by Passenger:
12.10.1.1 For Baggage which has been declared value, any additional fee for declared value service will be refunded if the withdraw application is made before departure. Such additional fee will not be refundable if that Baggage has been on carriage.
12.10.1.2 To withdraw Baggage at the departure airport, Passenger shall inform Spring Airlines prior to the loading to the aircraft. All related Baggage shall be withdrawn when Ticket is refunded. Any excess Baggage fee paid will be refunded. While at Stopover, unless time not permit, Spring Airlines shall facilitate withdraw request. Excess Baggage fee charged for the unused leg shall be refunded.
12.10.2 In cases of rerouting or cancellation due to Carrier or Force Majeure.
12.10.2.1 All excess Baggage fees and declared value charge for Baggage will be refunded while at the departure airport. At Stopover, Spring Airlines will only refund part of the excess Baggage fees that has not been carried and no charge for declared value shall be refunded.
12.10.2.2 In case Passenger has to be endorsed to another flight involuntarily, the Baggage shall be endorsed the same and the excess Baggage charge may be recalculated and, if any, the overcharged portion shall be refunded and no shortfall shall be required to make up. No charge for declared value service will be refunded.

Article 13 - Conduct aboard Aircraft
13.1 General
If, in Spring Airlines' judgment, Passengers conduct themselves aboard the aircraft so as to endanger the aircraft or any person or property on board, or obstruct the crew in the performance of their duties, or fail to comply with any instructions of the crew including but not limited to those with respect to smoking, alcohol or drug consumption, or behave in a manner which causes or threatens to cause discomfort, inconvenience, damage or injury to other Passenger or the crew, Spring Airlines may take such measures as Spring Airlines deem reasonably necessary to prevent continuation of such conduct, including restraint. Passenger may be disembarked and refused onward carriage at any point and Passenger may be prosecuted for offences committed on board the aircraft.
13.2 Electronic Devices
For safety reasons, Spring Airlines may forbid or limit operation aboard the aircraft of any electronic equipment, including, but not limited to, cellular telephones, laptop computers, portable recorders, portable radios, CD players, electronic game players or transmitting devices, including radio controlled toys and walkie-talkies. Operation of walkman, hearing aids and heart pacemakers is permitted.
13.3 Non-Smoking Flights
All Spring Airlines flights are non-smoking flights. Smoking or its alternative is prohibited in all areas of the aircraft.
13.4 Seat Belts Compulsory
While in seat on board the aircraft, a Passenger has the obligation to fasten Passenger's seat belt during the entire flight.

Article 14 -Arrangements for Additional Services
14.1 Spring Airlines provides no free meals and beverages during flight, while it provides various meals and beverages for Passengers to order in the cabin.
14.2 If Spring Airlines makes arrangements for the Passenger with any third party to provide any services other than carriage by air, or if Spring Airlines issues a ticket or vouchers relating to transportation or services (other than carriage by air) provided by a third party, such as ground transportation, hotel reservations or car rental, Spring Airlines does so only as Passenger's agent and takes no responsibility for the availability or the quality of such services. The terms and conditions of the third party service provider will apply.
14.3 If Spring Airlines provides above mentioned ground transportation or other services for the Passenger, these Conditions of Carriage shall not apply to such ground transportation or services.

Article 15 - Administrative Formalities
15.1 General
15.1.1 Passenger are responsible for obtaining all required travel documents and visas and for complying with all laws, regulations, orders, demands and travel requirements of countries to be flown from, into or through which Passenger transit.
15.1.2 Spring Airlines shall not be liable for the consequences to any Passenger resulting from his or her failure to obtain such documents or visas or to comply with such laws, regulations, orders, demands, requirements, rules or instructions.
15.2 Travel Documents
Prior to travel, Passenger must present all exit, entry, health and other documents required by law, regulation, order, demand or other requirement of the countries concerned, and permit us to take and retain copies thereof. Spring Airlines reserve the right to refuse carriage if Passenger has not complied with these requirements, or Passenger's travel documents do not appear to be in order.
15.3 Refusal of Entry
If a Passenger is denied entry into any country, the Passenger will be responsible to pay any fine or charge assessed against us by the government concerned and for the cost of transporting Passenger from that country. The fare collected for carriage to the point of refusal or denied entry will not be refunded by us.
15.4 Passenger Responsible for Fines, Detention Costs, Etc.
If Spring Airlines are required to pay any fine or penalty or to incur any expenditure by reason of Passenger's failure to comply with laws, regulations, orders, demands or other travel requirements of the countries concerned or to produce the required documents, Passenger shall reimburse us on demand any amount so paid or expenditure so incurred. Spring Airlines may apply towards such payment or expenditure the value of any unused portion of Passenger's Ticket, or any of Passenger's funds in our possession. In Passenger's own interests, be aware to observe the regulations of each country Passenger intend to travel to, from or through.
15.5 Customs Inspection
If required, Passenger shall attend inspection of Passenger's Baggage by customs or other government officials. Spring Airlines are not liable to Passenger for any loss or damage sustained by Passenger in the course of such inspection or through Passenger's failure to comply with this requirement.
15.6 Security Inspection
Passenger shall submit to any security checks required by governments, airport officials, Carriers or by us. Spring Airlines are not responsible for any injury caused to Passenger during or as a result of such security checks or for any loss or damage to any of Passenger's personal property as a result of such security checks, unless it is solely caused by our fault.

Article 16 -Successive Carriers
Carriage to be performed by Spring Airlines and other Carriers under one Ticket, or a Conjunction Ticket, is regarded as a single operation for the purposes of the Convention.

Article 17- Liability for Damage
17.1 Spring Airlines shall be liable for the death or personal injury of a Passenger, if the accident took place on board the aircraft or in the course of the operation of embarking on or disembarking from the aircraft, provided that the Carrier is not liable if the death or injury totally caused by the Passenger's health condition.
17.2 Spring Airlines will be liable for any destruction, loss of or damage to any Checked Baggage occurring during carriage in flight or within a period controlled by Spring Airlines. Spring Airlines will liable for the damage to Unchecked Baggage due to mistakes of Spring Airlines’ employee or agent. But Spring Airlines will not liable for the damage to Baggage (including Checked Baggage, Unchecked Baggage) if it caused by the defect, quality and flaw of the Baggage. Spring Airlines does not assume liability for normal wear and tear to Baggage, which includes: damage to or loss of protruding Baggage parts such as straps, pockets, pull handles, hanger hooks, wheels and feet, or other items attached to the Baggage as well as damage to over sized/over packed bags.
17.3 Spring Airlines will be liable for the damage to the Passenger and Baggage caused by Spring Airlines’ delay in the transportation. But Spring Airlines will not be liable for the damage if Spring Airlines’ employee or agent has taken all measures to avoid damage or it is impossible for him to take such measure. Damaged or delayed property must be reported to Spring Airlines according to Spring Airlines regulations and time limits, otherwise Spring Airlines is not liable for responsibility.
17.4 If it is confirmed that the losses are caused or facilitated by the faults of the claimant or the one from whom the claimant obtains rights, Spring Airlines will be exempted from liability or just bear reduced responsibilities according to the degree of such faults which have caused or facilitated the losses. If confirmed by Spring Airlines that other person rather than the Passenger requires compensation for the Passenger's injury or death and such injury or death is caused or facilitated by the Passenger's own faults, Spring Airlines will be exempted from liability or just bear reduced responsibilities according to the degree of such faults which have caused or facilitated the injury or death.
17.5 The limitation of liability
17.5.1 International Carriage as defined in the 1999 Montreal Convention is subject to the liability rules of such Convention.
17.5.2 International Carriage as defined in the 1929 Warsaw Convention and 1955 Hague Protocol but not in 1999 Montreal Convention, is subject to the liability rules of Warsaw Convention and Hague Protocol.
17.5.3 Where International Carriage is not subject to the liability rules of the Convention, it shall be subject to the related bilateral agreement of the People's Republic of China or its applicable laws, regulations or orders.
17.6 On the Limitation of Liability regulated in Convention
17.6.1 Warsaw Convention and Hague Protocol
17.6.1.1 The compensation for injuries or deaths paid by Spring Airlines to Passenger shall not exceed two hundred fifty thousand (250,000) French francs or its equivalent.
17.6.1.2 The compensation for Checked Baggage paid by Spring Airlines is no more than two hundred and fifty (250) French francs per kilogram or its equivalent. The compensation for Unchecked Baggage paid by Spring Airlines shall be no more than five thousand (5,000) French francs per Passenger or its equivalent. If no Baggage weight is recorded in the Baggage check, the weight of the Checked Baggage will be regarded as not exceed the free Baggage allowance to the related class of cabin. The compensation for Checked Baggage, which has been declared value according to Article 12.6.6 shall be within the value declaration.
17.6.2 1999 Montreal Convention
17.6.2.1 The compensation below one hundred and thirteen thousand one hundred (113,100) SDRs for injuries or deaths paid by Spring Airlines to Passenger is subject to the regulations of paragraph 20 and paragraph 21 subparagraph 1 of the Convention.
17.6.2.2 For Damage caused by delay in the carriage of Passengers, Spring Airlines’ liability is limited to four thousand six hundred and ninety four (4,694) SDRs for each Passenger. But Spring Airlines will not be liable for the damage if Spring Airlines’ employee or agent has taken all measures to avoid damage or it is impossible for him to take such measures.
17.6.2.3 The compensation for Baggage (including Checked Baggage and Unchecked Baggage) paid by Spring Airlines to Passenger is no more than one thousand one hundred and thirty one (1131) SDRs or its equivalent. The compensation for Checked Baggage, which has declared value according to Article 12.6.6 shall be within the value declaration.
17.7 To the extent not in conflict with the foregoing and regardless whether or not the Convention applies, the following rules shall apply to the carriage:
17.7.1 Spring Airlines is liable only for damage occurring on its own airline. Spring Airlines issuing Ticket or checking Baggage over the airlines of another Carrier does so only as agent for such other Carrier.
17.7.2 Spring Airlines is not liable for any damage arising from its compliance with any laws or government regulations, orders or requirements, or from failure of the Passenger to comply with the same.
17.7.3 Spring Airlines' liability shall not exceed the amount of proven damage. Spring Airlines shall in no event be liable for any indirect damages, consequential damages or punitive damages.
17.7.4 Spring Airlines is not liable for injury to a Passenger or for damage to a Passenger's Baggage caused by property contained in such Passenger's Baggage. Any Passenger whose property causes injury to another person or damage to another person's property or to the property of Spring Airlines shall indemnify Spring Airlines for all losses and expenses incurred by Carrier as a result thereof.
17.7.5 Spring Airlines is not liable for damage to fragile or perishable items, money, jewelry, precious metals, silverware, negotiable papers, securities or other valuables, business documents, passports and other identification documents, samples, medicines or drugs, which are included in the Passenger's Baggage.
17.7.6 Spring Airlines shall not be liable for any illness, injury, disability or death resulted from existing hazard or risk originate from age, improper mental or physical condition of the Passenger.
17.7.7 Any exclusion or limitation of liability of Spring Airlines shall apply to and be for the benefit of agents, employees and representatives of Spring Airlines and any person whose aircraft is used by Spring Airlines and Spring Airlines' agents, employees and representatives. The aggregate amount recoverable from Spring Airlines and from such agents, employees, representatives and persons shall not exceed the amount of Spring Airlines' limit of liability.
17.8 Unless so expressly provided, nothing herein contained shall waive any exclusion or limitation of liability of Carrier under the Convention or applicable laws.

Article 18 - Time Limits for Complaints
18.1 Acceptance of Baggage by the bearer of the Baggage Check without complaint at the time of delivery is sufficient evidence that the Baggage has been delivered in good condition and in accordance with the contract of carriage, unless the Passenger proves otherwise.
18.2 For any complaint of damaged Checked Baggage, it shall be in writing to Spring Airlines immediately upon finding of the Damage and at the latest, within seven Days from the date of receipt of the Checked Baggage.
18.3 For delayed Checked Baggage, any acceptable complaint shall be in writing and made to Spring Airlines within 21 Days at the latest of the Checked Baggage being made available to him.
18.4 Unless due to the fraud of Spring Airlines, if no complaint is made within the time specified in Article 18.2 and 18.3, no action shall be filed against it.

Article 19- Limitation of Actions
In accordance with the Montreal Convention, any right to damages shall be extinguished if an action is not brought within two years of the date of arrival at destination, or the date on which the aircraft was scheduled to arrive, or the date on which the carriage stopped.

Article20 - Miscellaneous Conditions
20.1 Carriage of a Passenger and his Baggage is also provided in accordance with other regulations and conditions applying to or adopted by Spring Airlines. These other regulations and conditions are important and may be varied from time to time. They may concern, among other things, the carriage of a special Passenger, restrictions on use of electronic devices, the on board consumption of alcoholic beverages, etc. These regulations and conditions are available from Spring Airlines upon request or on www.ch.com.
20.2 These Conditions of Carriage shall also apply to transportation between mainland China and Hong Kong SAR, Macao SAR or Taiwan region.
20.3 The title of each Article of these Conditions of Carriage is for convenience only and is not used for interpretation of the text.
20.4 The Condition of Carriage is done in the Chinese language, and any other language of the text shall only be for reference.

Article-21 Effectiveness and Modification
21.1 These Conditions of Carriage shall become effective as of the date on March 10th, 2010.
21.2 Spring Airlines has the right to modify these Conditions of Carriage, regulations of carriage, Tariffs and charges without prior notice. This kind of modification does not apply to carriage that has already begun prior to such modification.
